What is Mitigation?
Mitigation in criminal defense is the 'why' behind the crime.
It tells the accused person’s story. It asks a judge or jury to look beyond the immediate loss and consider the significant life circumstances leading up to a crime. Mitigation does not seek to excuse the actions of an individual. Its aim is to help decision makers determine a unique punishment based on a whole person.
